Does OHIM refund budget surplus?

The costs related to the Registration of European Marks might be partially refunded.

The OHIM (Office for harmonization in the Internal Market) has made a proposition regarding the accumulated surplus of approximately 300 million Euros.

Convinced that the present proposal, based on the financing of collaborative anti-counterfeiting projects, does not assure a controlled assurance that it will benefit the users, OHIM has looked into the question of whether and how this remaining sum could be returned to users themselves.

The refund would be around € 600 for all registrations prior to October 2005 and about € 400 from that date onwards until the end of 2008; refunds would only take place FOLLOWING AN APPLICATION by the owner of the mark.
