The Safety Business Gateway under EU Regulation 2023/988 (GPSR) is a mandatory online portal within the broader Safety Gate system where businesses (manufacturers, importers, distributors, online marketplaces) must report dangerous non-food products, accidents, and corrective actions to national market surveillance authorities and the European Commission, ensuring rapid communication and compliance with general product safety rules.

It serves as the official channel for economic operators to fulfill their obligation to inform authorities and consumers about unsafe products, complementing the rapid alert system and public portal. 

Guideline

Businesses are required to use the Safety Business Gateway in specific situations, depending on their role in the supply chain. This applies when they act as an economic operator—such as a manufacturer, authorised representative, importer, distributor, fulfilment service provider, or any other party responsible for producing or placing products on the market under the GPSR—or when they operate an online marketplace.

Only these economic operators and online marketplace providers may submit notifications through the Safety Business Gateway, and only when the GPSR requires it. This includes notifications related to dangerous products under Articles 9, 10, 11, 12 and 22, as well as accident notifications under Article 20. Any third parties who are not responsible for the product concerned—such as competitors—cannot use the Gateway for such submissions.

Accidents that must be reported under Article 20 are those in which the use of a product has led to a person’s death or caused serious health and safety consequences. These consequences may be temporary or permanent and can include injuries, illnesses, body damage, or other significant adverse effects.

Article 20(1) makes it clear that the obligation to report accidents through the Safety Business Gateway applies to all products, including those already governed by EU harmonisation legislation as defined in Article 3(27) of the GPSR.
