X versus Y document

Once a patent application is filed, the authorities will verify whether the claimed invention is amongst others NEW and INVENTIVE in view of what is already known in the WORLD before issuing the patent. The rapport that is sent to the applicant sometimes refers to X and/or Y documents:
X-documents indicate that (part of) the invention is not NEW; in the light of these documents the invention cannot be considered as new
Y-documents indicated that (part of) the invention is not INVENTIVE; in the light of these documents, the invention cannot be considered as inventive
Therefore, a report containing a lot of X and Y documents is not a positive report.

Na het indienen van een patentaanvraag onderzoekt de overheid of de uitvinding onder andere NIEUW en INVENTIEF is ten opzichte van wat al in de WERELD gekend is vooraleer een patent toe te kennen. Op het onderzoeksrapport dat de aanvrager daarover ontvangt worden soms X en/of Y documenten vermeld:
X-documenten geven voor (een deel van) de uitvinding aan dat de uitvinding niet NIEUW is; in het licht van deze documenten kan je de uitvinding niet nieuw noemen
Y-documenten geven voor (een deel van) de uitvinding aan dat de uitvinding niet INVENTIEF is; in het licht van deze documenten kan je de uitvinding niet inventief noemen
Een rapport waarin veel X en Y documenten voorkomen is dus ‘geen positief’ rapport.

Suite à l'introduction d'une demande de brevet, les autorités vérifient si l'invention est entre autres NOUVELLE et INVENTIVE par rapport à l'état des connaissances dans le MONDE. Le rapport de recherche qui est envoyé au demandeur mentionne parfois des documents X et/ou Y:
Les documents X indiquent que l'invention (dans son entièreté ou en partie) n'est pas NOUVELLE; c.à.d. par rapport à ces documents, l'invention n'est pas nouvelle
Les documents Y indiquent que l'invention (dans son entièreté ou en partie) n'est pas INVENTIVE; c.à.d. par rapport à ces documents, l'invention n'est pas inventive
Par conséquent, un rapport comportant beaucoup de documents X et Y n'est pas un rapport positif.
